Booking Terms & Conditions

1. Definitions:

The Agent‘ means VHP Holiday Property Ltd (Trading as Algarve Holiday Property)

The Unit’ means the holiday accommodation available for occupation.

The Owner‘ means the person (s) who owns the unit.

The Guest‘ means the person (s) who has (have) booked the unit for holiday purposes through the agent.

The Booking Period‘ means the period of time of the occupation of the unit by the guest as agreed with the Agent .

The Contract’ shall be between the Owner and Guest.

2. Booking Procedures and Conditions:

a) All bookings are subject to these Booking Terms and Conditions unless otherwise agreed in advance in writing by either the owner or agent.

b) Bookings cannot be accepted by persons under the age of 18 years.

c) In order to secure a booking, a non-refundable deposit of 25% of the full agreed rental charge must be paid to the Agent and the Guest must complete the Agent’s on-line Booking Information Form.

d) Upon receipt of the 25% deposit and Booking Information Form the Agent will confirm the booking in writing by email.

e) The balance of the rental charge is payable no later than 28 days before the start of the rental period.

f) If the booking is made 28 days or less from the start of the rental period, the full rental charge is due immediately at the time of the booking.

g) The Guest acknowledges that the Tenancy granted by the Contract during the period is not an assured tenancy and that no statutory periodic tenancy will arise when it ends.

h) The Agent or Owner may, at their discretion, refuse any booking.

3. Rental Period and Arrival / Departure Times

a) The arrival and departure dates will be agreed at the time of booking.

b) Late arrivals incur a late arrival fee payable on arrival to your property manager: After 20.00 hours £/€20.00 – After 21.00 hours £/€30.00 and after midnight £/€40.00

c) The Guest shall arrive not before 3pm on the first day of the period and shall vacate the Unit not later than 11am on the last day of the period. The Agent will always endeavour to accommodate requests for early arrival and/or late departure if the unit has no other booking on that date. However, such requests must be made at the time of booking and any agreement will be in writing from the Agent.

d) Unless the Guest notifies the Agent otherwise, occupation of the Unit must commence no later than 12 noon on the day following the first day of the Period. If such occupation has not taken place the Guest shall be deemed to have cancelled his booking. In this event Condition 10 shall apply.

4. Rental Charges and Facilities Included

a) The advertised rental charge for all Units is based in Sterling (GBP). However, the Agent is also able to accept payment in Euros. The amount payable in Euros will be fixed at the time of booking and based on the exchange rate at the time of booking. Euro based bookings cannot be made on-line and must be requested in writing to the Agent.

b) The advertised rental charge is inclusive of all utilities such as Gas, Electricity and Water. It also includes use of air conditioning, where provided.

c) All linen, bedding, and towels (excluding beach towels) are provided.

d) All Units are let and priced on a self-catering basis with most facilities including washing machine and dish washer. The Unit is thoroughly cleaned and prepared before guest arrival with clean towels and bedding. Please note that Maid Service NOT provided. However, where a guest requires a mid-stay clean and/or fresh towels and linen, this can be provided if requested in advance at the time of booking. The charge will be agreed in advance, confirmed in writing, and must be paid directly to the property managers before the departure date.

5. Rental Charge - Payment Methods

a) The preferred payment method for Rental Charges is by electronic Bank Transfer.

b) It is also possible to pay by credit or debit card via PayPal. However, please note that the Agent reserves the right to recover any additional charges made by PayPal for this service. (2.5% of the amount paid)

c) Payment by cheque or bankers draft will incur an administration fee from €20.00 for Euro payments and from £20.00 for Sterling payments.

d) All on-line booking payments via the Holiday Lettings website must be made via PayPal.

6. Maximum Number of Guests and Restrictions of Use

a) The number of people staying in the Unit must not exceed the maximum number stated in the literature promoting the Unit, unless otherwise agreed at the time of booking.

b) All Units offered by the Agent are aimed at the family holiday accommodation market and the Agent does not encourage bookings from same sex groups especially hen and stag parties. However, the Owner and Agent are willing to consider such requests subject to an additional security deposit being paid.

c) It is not permitted to keep or entertain pets in any Unit.

d) All Units are non-smoking.

e) The Guest must not use the Unit or allow its use for any dangerous, offensive, noisy, illegal, or immoral activities or carry on there any act that may be a nuisance or annoyance to any neighbours.

f) The Guest shall forfeit without refund or compensation his / her right to occupy the Unit when (a) pets or persons not specified on the Booking Information Form attempt to take up occupancy, or (b) additional persons or pets are entertained at the Unit without the express permission of the Owner or the Agent, or (c) any activity occurs which may cause unreasonable noise, disturbance or damage.

g) The Owner and/or Agents representative shall be entitled at any time to enter-into the Unit to examine its condition and condition of its furniture, fixtures, and contents.

7. Security/Damage Deposit

a) A Security/Damage Deposit must be paid with the final balance payment.

b) The amount of Security/Damage Deposit required varies from Unit to Unit, dependent on Unit size and furnishings. The Agent or Owner may impose a greater than normal Security/Damage Deposit, as they see fit.  This will principally apply to large groups or single sex groups such as Hen and Stag parties.  The amount charged will be confirmed in writing at the time of booking.

c) The Security/Damage Deposit is paid in the same currency as the agreed rental charge.

d) At the end of the period the Guest shall leave the Unit and its furniture, fixtures and fittings and all other contents in the same state of repair, cleanliness, and order as it was found at the commencement of the Period. Any breakage, loss or damage arising during the Period must be reported by the Guest to the Owner or the Agency immediately. The Owner or the Agency shall be entitled to charge for the cost of repair or replacement or to deduct such sums from any security deposit paid by the Guest. This includes removal of rubbish not disposed of by the Guest on their departure from the Unit. Any rubbish left by the Guest will be charged at 5.00 Euro per bag.

e) The Security/Damage Deposit is refunded to the Guest by bank transfer as soon as possible after the Guest's departure. This is normally within five days of departure, but no later than 10 working days after the end of the rental period, subject to a satisfactory inspection of the unit. The Guest is required to provide bank details in order for the refund to be made.

8. Unit Description and Facilities

a) Whilst every effort is made to ensure that statements, descriptions and particulars of the Unit are accurate and that the Unit will be available for the Guest as arranged, neither the Owner nor Agent are liable if the Unit does not meet the requirement of the Guest (s). Prior to concluding the booking, the Guest (s) must ensure that the Unit they have chosen is entirely suitable for all members of their party.

b) The Agent and the Owner reserve the right to alter or withdraw facilities or amenities which have been advertised or previously available without prior notice where reasonably necessary due to repairs, maintenance, weather conditions and other circumstances beyond their control.

c) Any information provided by the Owner or Agent relating to nearby amenities is given in good faith and neither the Agent nor Owner can be held responsible if these amenities are withdrawn or amended.

9. Cancellation by Agent

a) In the unlikely event of the Unit becoming unavailable for rental due to circumstances beyond the control of the  Agent, the Agent will endeavour to provide suitable alternative accommodation or will refund all rental monies paid or a proportion in the case of curtailment.

b) The Agent will notify the Guest of any cancellation or change to the Booking as soon as is reasonably practical.

c) Where a booking is cancelled or amended, neither the Agent nor Owner accept any liability for financial loss in relation to fees paid by the Guest to a third party in connection to the holiday.  These include without limitation, fees for travel, entertainment, activities and insurance.

10. Cancellation by Guest

a) If the Guest requires to cancel his / her booking they must notify the Agent immediately in writing.

b) Guests cancelling within 28 days of the booking arrival date may remain liable for the full amount of rental monies due. The Agent will make reasonable endeavours to obtain a replacement booking but if it fails to do so the Guest will be liable to the Agent for the full amount due.

c) Guests cancelling up to 28 days before the booking arrival date will receive a minimum refund of 50% of the balance payment.

d) In any event an amount equal to 25% of the accommodation cost (the deposit) will not be returnable by the Agent.

e) Deposits are not transferable.

11. Alterations and Amendments Requested by the Guest

a) The Agent reserves the right to charge an administration fee in respect of any alterations made to a booking after the booking confirmation has been issued by the Agent (whether received by the Guest or not). This fee will be subject to a maximum of £/€25 per amendment.

12. Loss and Injury

a) The Owner and Agent accept no responsibility for personal injury to Guests, or loss of or damage to their property or for other matters over which the Owner or Agent has no control.

b) The Owner or Agent’s maximum liability for losses suffered by the Guest as a result of the Owner or Agent acting in breach of these Terms and Conditions is strictly limited to the total fees paid by the Guest for the booking.

c) Any booking is made by the Guest as a consumer of a holiday and the Guest acknowledges that neither the Owner nor Agent will be liable for any business losses however suffered or incurred by the Guest.

13. Insurance and Medical Cover

a) The Owner and Agent strongly recommend that Guests arrange appropriate holiday insurance, it is recommended that such insurance is arranged as soon as your deposit is paid and confirmed by the Agent. Guests should also ensure they have a valid European Health Insurance Card (previously E111). In order to obtain your EHIC free of charge visit https://www.ehic.org.uk/Internet/home.do

14. Complaints

a) In the event of there being a complaint concerning the Unit the matter must be taken up immediately by the Guest with the Agent. The Agent regrets that it is unable to deal with any complaint after the end of the Rental Period and the Guest has left the property or returned home.

15. General

a) The Guest may not transfer any booking or any rights and responsibilities of these Booking Terms and Conditions to any other person without prior written consent of the Agent or Owner.

b) If at any time any part of these Booking Terms and Conditions is held to be unenforceable for any reason under any applicable law, that part shall be deemed omitted and the enforceability of the remaining parts shall not in any way be affected by that omission.

16. Law

The Contract between the Owner and Guest shall be governed solely by these conditions of business and shall be subject to the laws of England and Wales.
